NOTICE OF REVOCATION Case No. 08-150-MZ (Ref. 07-109-GA) Notice Issued: June 3, 2009
David A. Kuzava, P49963, Hastings, Michigan, by the Attorney Discipline Board Kalamazoo County Hearing Panel #3. 1. Revocation 2. Effective June 2, 2009 1
The Grievance Administrator filed a petition on October 27, 2008 seeking entry of an order increasing discipline for respondent's failure to comply with the hearing panel's order of January 15, 2008. The respondent did not appear at the show cause hearing held on March 6, 2009.
Based upon the evidence and testimony submitted by the Grievance Administrator, the panel concluded that respondent had not complied with its previous order, specifically, that
respondent failed to give notice of his suspension to his active clients, as required by MCR 9.119(A); failed to pay the discipline costs which were assessed; and continued to practice law after the effective date of his suspension. Additionally, when seeking automatic reinstatement, respondent filed a sworn affidavit with the Michigan Supreme Court, the Attorney Grievance Commission, and the Attorney Discipline Board which contained the false statement that he "did not engage in the practice of law in any form and have otherwise fully complied with the terms and conditions of said Order."
The panel ordered that respondent's license to practice law in Michigan be revoked and assessed costs in the amount of $1,730.64.
John F. Van Bolt Dated:dUN - 32009
1 Respondent has been continuously suspended from the practice of law in Michigan since February 6, 2008. See Notice of Suspension, issued February 8, 2008.
