NOTICE OF REPRIMAND (ON REMAND) Case No. 07-14-GA Notice Issued: October 30, 2009 Anthony C. Greene, P 49303, Grand Rapids, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #2.

1. Reprimand 2. Effective July 28,2009 The hearing panel originally dismissed the formal complaint, finding that professional misconduct, as alleged, had not been established. The Grievance Administrator filed a timely petition for review.

Upon review, the Board affirmed the panel's dismissal of the allegation that respondent had knowingly failed to respond to a lawful demand for information from a disciplinary authority, contrary to Michigan Rules of Professional Conduct 8.1 (a)(2). However, the Board reversed the panel's dismissal of the charge that respondent failed to file a timely answer to a request for investigation, in violation of MCR 9.1 04(A)(7) and MCR 9.113(A) and (B), and remanded the matter to the panel for a hearing on discipline.

After a hearing on discipline, and based on the Board's findings of professional misconduct, the panel ordered that respondent be reprimanded. Costs were assessed in the amount of $2,478.97.
