FINAL NOTICE OF SUSPENSION Case No. 08-83-GA Notice Issued: June 3, 2009

1. Suspension - Three Years 2. Effective April 11, 2009 The hearing panel found that respondent failed to deposit funds belonging to a third party into his IOlTA account; failed to promptly payor deliver any funds that the client or third person is entitled to receive; failed to keep the funds separate until the dispute was resolved between his clients and the opposing party; violated or attempted to violate the Rules of Professional Conduct; and engaged in conduct involving dishonesty, fraud, deceit, misrepresentation, or violation of the criminal law where such conduct reflects adversely on the lawyer's honesty, trustworthiness, or fitness as a lawyer. Respondent's conduct was in violation of Michigan Rules of Professional Conduct 1.15 and 8.4(a) and (b).

The panel ordered the respondent's license to practice law be suspended for three years. Respondent filed a petition for review and stay of discipline, and the Grievance Administrator filed a cross-petition for review, seeking an increase in discipline. The Board denied respondent's request for a stay of discipline and scheduled the matter for a review hearing.

On May 12, 2009, respondent filed a motion to withdraw his petition for review and the Grievance Administrator filed a similar motion on May 28, 2009. The Board granted both motions in separate orders dated May 21, 2009, and May 29, 2009, respectively, and adjourned the review hearing. Total costs were assessed in the amountof $2,416.24.
