Respondent entered a plea of guilty on February 5, 2008 in the Wayne County Circuit Court to the offense of Operating a Motor Vehicle While Impaired by Liquor, Third Offense, a felony in violation of MCl 257.6256-0.

A discipline proceeding was instituted by the Grievance Administrator in accordance with MCR 9.120(B)(3). The Grievance Administrator, with the approval of the Attorney Grievance Commission, agreed that, in lieu of disciplinary proceedings, respondent should be permitted to resign his membership in the State Bar of Michigan. However, respondent's resignation was not accepted by the State Bar for the reason that he was, at the time of the proffered resignation, an inactive member of the Bar and the Bar's rules allow resignation only by active members.

Upon the re-institution of discipline proceedings under MCR 9.120, respondent appeared before a hearing panel and requested that he instead be allowed to resign under MCR 9.115(M), which states that an attorney's resignation while a discipline charge or investigation is pending may not be accepted except pursuant to an order of revocation. Respondent's request was accepted by the panel and an order revoking his license to practice law in Michigan was entered effective

April 9, 2009. Costs were assessed in the amount of $1,653.47.
