NOTICE OF REPRIMAND (By Consent)

Martin O. Kirk, P 43330, St. Joseph, Michigan, by the Attorney Discipline Board Berrien County Hearing Panel #1.
1. Reprimand 2. Effective February 11, 2009 The respondent filed an answer to the formal complaint and appeared at the hearing. Based on the testimony presented, the hearing panel found that respondent's post-hearing conduct in a courthouse parking lot, where he used intemperate language, constituted professional misconduct, in violation of MCR 9.1 04(A)(2).
Based on the hearing panel's findings of misconduct, the respondent and the Grievance Administrator filed a stipulation for a consent order of discipline in accordance with MCR 9.115(F)(5) which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The parties agreed, based on the misconduct found by the hearing panel, that respondent should be reprimanded.
The hearing panel ordered that respondent be reprimanded and assessed costs in the amount of $2,913.07.
