1. Reprimand 2. Effective February 28, 2009 The respondent was found to be in default for failing to file an answer to the formal complaint, but he -did appear at the hearing. While the allegations in the formal complaint were deemed to be admitted by respondent's default, the hearing panel found that the record did not provide a sufficient basis for finding that respondent had committed all of the professional misconduct alleged in the formal complaint. Based on the evidence submitted, the panel found that respondent failed to keep a client reasonably informed; failed to refund an unearned fee; engaged in conduct that exposes the legal profession to obloquy, contempt, censure or reproach; failed to file a timely answer to a request for investigation; and failed to respond to the Grievance Administrator's lawful demands for information. Respondent's conduct was in violation ofMCR 9.1 04(A)(1 )-(3) and (7); MeR 9.113(A) and (8)(3); and Michigan Rules of Professional Conduct 1.4(a); 1.16(d); 8.1(a)(2); and 8.4(a) and (c).
The panel ordered that respondent be reprimanded and pay restitution in the amount of $1,000.00. Respondent was also ordered to comply with a condition relevant to the established misconduct. Costs were assessed in the amount of $1,724.50 .
