FINAL NOTICE OF SUSPENSION AND RESTITUTION Case No. 07-11 O-GA Notice Issued: March 11, 2009 Gerald A. Bagzinski, P. 41264, Livonia, Michigan, by the Attorney Discipline Board, affirming the order suspension of Tri-County Hearing Panel #8,

1. Suspension - 30 Days 2. Effective March 7, 2009 Respondent was in default for failing to file an answer to the formal complaint, but he did appear at the hearing. Based on his default, the hearing panel found that respondent neglected three legal matters entrusted to him; failed to seek the lawful objectives of his clients through reasonably available means permitted by law; failed to act with reasonable diligence and promptness; failed to keep his clients reasonably informed about the status of their matters and to respond to requests for information; failed to promptly deliver property that the clients were entitled to receive.; failed to surrender papers and propertyto which the clients were entitled; failed to refund unearned fees paid to him by one of his clients, failed to surrender client property upon termination of the representation; knowingly failed to respond to a lawful demand for information from a disciplinary authority; and failed to answer two requests for investigation served upon him by the Grievance Administrator.

Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4) and (7); MCR 9.113(A) and (8)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a); 1.15(b)(3); 1.16(d); 8.1(a)(2); and 8.4(a) and (c).

The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 30 days and that he pay restitution in the amount of $575.00.

Respondent filed a motion for reconsideration, which was denied by the panel. Respondent then ·filed a petition for review and requested a stay of the discipline, Which was granted. Upon review, the Attorney Discipline Board affirmed the hearing panel's Order of Suspension and Restitution. Total costs were assessed in the amount of $2,484.80.
