The Grievance Administrator filed a petition for order to show cause on July 29, 2008, seeking additional discipline for respondent's failure to comply with the hearing panel's order of probation, issued April 20, 2007. Specifically, the Grievance Administrator alleged that respondent failed to comply with conditions including, but not limited to, abstinence and monitoring by the Lawyers and Judges Assistance Program (LJAP). In support of respondent's non-compliance, the Grievance Administrator attached to the petition for order to show cause a report from LJAP stating that respondent had not been in contact with the program; along with a police report showing that respondent was arrested while in possession of marijuana and alcohol.

Respondent did not appear at the show-cause hearing and the panel found him in default for his failure to file an answer to the petition. Based on that default, the panel found that respondent had failed to comply with its order of probation issued April 20, 2007.

The panel ordered that respondent be suspended for 180 days, with a condition relevant to the established misconduct. Total costs were assessed in the amount of $1,778.46.
