NOTICE OF PROBATION WITH CONDITIONS (By Consent)

Case No. 08-148-JC Notice Issued: January 19, 2009

- Thomas O. Mix, Jr., P 62659, Lansing, Michigan, by the Attorney Discipline Board Ingham County Hearing Panel #2.

1. Probation - 2 Years 2. Effective January 6, 2009 The Grievance. Administrator and respondent filed a stipulation for a consent order of discipline pursuant to MCR 9.11 5(F)(5). The stipulation contained respondent's admission that he was convicted of 12 felony counts of wrongful possession of Schedule IV controlled substances (prescription drugs), in violation of Mel 333.74032B-A. The stipulation further stated that respondent's plea was accepted by the court but was then deferred pursuant to Mel 333.7411 and

respondent was placed on probation for a period of 60 months. The stipulation was approved by the Attorney Grievance Commission and accepted by the hearing panel.

Based on respondent's conviction, the h~aring panel found that respondent committed professional misconduct in violation of MCR 9.1 04(A)(5).

The hearing panel ordered that respondent be placed on probation for two years and be subject to conditions relevant to the admitted mi,~conduct.Total costs were assessed in the amount of $ 776.54.
