NOTICE OF SUSPENSION WITH CONDITION Case No. 08-38-MZ (Ref. 06-94-GA; 06-99-GA; 07-40-GA)

Notice Issued: November 13, 2008

Brian C. Casterline, P 57723, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #61.

1. Suspension - Two Years 11 Months 2. Effective November 8,2008 1 The Grievance Administrator filed a petition for order to show cause on April 2, 2008 seeking additional discipline for respondent's failure to comply with the hearing panel's order of July 31,2007. Specifically, the Grievance Administrator alleged t~at respondent failed to comply with the conditions of the hearing panel's order of probation, specifically, that he failed to submit a plan of therapeutic treatment from his doctor, failed to ensure the filing of quarterly reports with the Grievance Administrator; failed to secure an independent psychiatric report and pay for same; failed to provide waivers allowing the Grievance Administrator to communicate with and obtain information concerning his treatment from his doctor; and failed to ensure the filing of monthly reports from his monitor verifying his satisfactory progress.

Respondent did not appear at the hearing and the panel found him in defau.lt for his failure to answer the petition for order to show cause. Based on that default, the panel found that respondent had failed to comply with its order of probation issued July 31,2007.

The panel ordered that respondent be suspended for two years and 11 months with a condition relevant to the established misconduct. Total costs were assessed in the amount of $4,065.19.
