NOTICE OF SUSPENSION WITH CONDITIONS (By Consent)

Case No. 08-126-RD Notice Issued: December 12,2008 Carl D. Macpherson, III, P 16955, Tucson, Arizona, by the Attorney Discipline Board Tri-County Hearing Panel #3.

1. Suspension - 30 Days 2. Effective December 1, 2,008 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F){5), which was approve'd by the Attorney Grievance Commission and accepted by the hearing panel.. The stipulation contains respondent's admission that he was suspended from practice for 30 days and placed on a one year probation by the Supreme Court of Arizona. The parties agreed that respondent shall be suspended from the practice of law in Michigan for 30 days, and be subject to certain conditions consistent, but not identical, to the conditions contained in the order of suspension entered in Arizona.

Pursuant to the agreement of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 30 days and that he be subject to certain conditions relevant to the established misconduct. Costs were assessed in the amount of $760.98.
