NOTICE OF SUSPENSION WITH CONDITIONS (By Consent)

Case No. 08-19-GA Notice Issued: November 19,2008 William J. Napieralski, P 28086, Grand Rapids, Michigan, by the Attorney Discipline Board Kent County Hearing Panel #5.

1. Suspension - 120 Days 2. Effective November 1, 2008 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the allegations that he neglected a legal matter; failed to act with reasonable diligence and promptness; failed to keep his client reasonably informed about the status of a matter and to comply promptly with reasonable requests for communication; knowingly failed to respond to a lawful demand for information from a disciplinary authority; and failed to answer a request for investigation served upon him by the Grievance Administrator, in violation of MCR 9.1 04(A)(4) and (7); MeR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.3; 1.4(a); 8.1 (a)(2); and 8.4(a).

Pursuant to the agreement of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 120 days, effective November 1,2008. The panel also ordered that respondent be subject to conditions relevant to the alleged misconduct. Costs were assessed in the amount of $1 ,086.21.
