NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION Case No. 07-194-GA Notice Issued: December 12,2008 Shela S. Khan-Monroe, P 62129, Bay City, Michigan, by the Attorney Discipline Board "Tri-Valley Hearing Panel #1.

1. Suspension - 45 Days 2. Effective December 12, 2008 Respondent filed an answer to the formal complaint and appeared at the public hearing. Based on respondent's admissions, the hearing panel found that respondent neglected a legal matter entrusted to her; failed to seek her client's lawful objectives; failed to act with reasonable diligence and promptness in representing her client; failed to promptly render a full accounting of the monies paid to respond"ent upon request by the client or third person; failed to surrender papers and property to which the client is entitled and failed to refund the advance payment of monies; violated or attempted to violate the Rules of Professional Conduct; and failed to file an answer to the request for investigation served upon her by the Grievance Administrator.

Respondent's conduct was in violation of MCR 9.104(A)(4) and (7); MeR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 1.15(b)(3); 1.16(d); 8.1 (a)(2); and B.4(a). The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 45 days and that she pay restitution in the amount of $1 ,OOB.OO. The panel also ordered that respondent be subject to a condition relevant to the established misconduct.

Respondent filed a petition for review and requested a stay of the discipline, which was granted. Upon review, the Attorney Discipline Board affirmed the hearing panel's Order of Suspension and Restitution With Condition. Respondent filed a motion for reconsideration, which was denied' by the Attorney Discipline Board on November 13, 200B. Total costs were assessed in the amount of $1 ,901.B7.
