Suspension - 24 Months Effective December 11, 20081

On November 19, 2008, the hearing panel ordered the suspension of respondent's license to practice law in Michigan for a period of two years, commencing December 11 , 2008, in Grievance Administrator v Robert E. Jones, ADB Case No. 08-135-RD. Because the reciprocal discipline proceeding was consolidated with this matter, the order of suspension was entered on an interim basis pending the panel's decision on the charges of misconduct in Grievance Administrator v Robert E. Jones, ADB Case No. 08-07-GA, and, if applicable, the panel's determination of an appropriate sanction for the misconduct charged in that case.

In Grievance Administrator v Robert E. Jones, ADB Case No. 08-07- GA, the panel found that respondent committed professional misconduct by engaging in the "unauthorized practice of law," during a suspension in the United States District Court for the Eastern District of Michigan;

violated a rule or obligation of a tribunal; held himself out as authorized to practice law in federal court when he was not so authorized; and commingled trust funds with his personal funds. Respondent's conduct was in violation of U.S. District Court, Eastern District Local Rule 83.20(i);

and Michigan. Rules of Professional Conduct 1.15(d); 3.4(c); 5.5(a); 8.4(b) and (c).

The panel ordered that respondent's license to practice law be suspended for 24 months, to run concurrently with the suspension ordered in Grievance Administrator v Robert E. Jones, ADB Case No. 08-135-RD. Total costs were assessed in the amount of $2,432.30.
