FINAL NOTICE OF REVOCATION Case No. 07-96-GA Notice Issued: March 10, 2009 Michael J. Brogan, P 40047, Lansing, Michigan, by the Attorney Discipline Board, affirming the order of revocation issued by Ingham County Hearing Panel #7.

1. Revocation 2. Effective October 25, 2008 Respondent filed an answer to the formal complaint and appeared at the public hearing before Ingham County Hearing Panel #7. At the hearing, the panel found that respondent had committed misconduct when he failed to hold property of his client or third persons separate from his own and in an IOLTA; failed to promptly deliver funds to a third party; misappropriated client or third-party funds; failed to maintain an interest-bearing trust accountfordeposit of client funds; and, in his answer to a request for investigation, failed to fully and fairly disclose all the facts and circumstances pertaining to the alleged misconduct, in violation of MCR 9.1 04(A)(1 )-(4); MCR 9.113(A); and Michigan Rules of Professional Conduct 1.15(a)-(c); 1.15(d) (formerly 1.15(a)); 1.15(b)(3) (formerly MRPC 1.15(b»; and 8.4(a)-(c).

In an order entered July 9, 2008, the hearing panel ordered the revocation of respondent's license to practice law. That order was stayed by stipulation of the parties in connection with respondent's petition for review by the Attorney Discipline Board. Respondent and the Grievance Administrator subsequently filed a further stipulation dissolving the stay of discipline effective

October 25,2008.

Review proceedings were held before the Attorney Discipline Board on January 19, 2009 and the Board affirmed the hearing panel's order of revocation in an ordered issued February 6, 2009. Total costs were assessed in the amount of $2,837.77.
