NOTICE OF SUSPENSION AND RESTITUTION Case No. 08-128-GA Notice Issued: January 12, 2009 Janet K. Harsh, P 43466, Tecumseh, Michigan, by the Attorney Discipline Board Washtenaw County Hearing Panel #1.

1. Suspension - 180 Days 2. Effective December 30, 2008 Respondent did not appear at the hearing and was found to be in default for failing to file an answer to the formal complaint. Based on respondent's default, the hearing panel found that respondent committed professional misconduct in an estate planning matter when she neglected

the legal matter; failed to act with reasonable diligence and promptness; failed to keep her clients

reasonably informed of the status of a matter; failed to refund an unearned portion of an advance fee; failed to explain a matter to her clients to the extent necessary to permit her clients to make informed decisions regarding the representation; and failed to answer a request for investigation, in violation of MCR 9.1 04(A)(1 )-(4) and (7); 9.113(A) &(B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.3; 1.4{a)-(b); 1.16(d); 8.1(a)(2); and 8.4{a) and (c).

The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and that she pay restitution in the amount of $350.00. Costs were assessed in the amount of $1,711.45.
