NOTICE OF REPRIMAND AND RESTITUTION (By Consent)

1. Reprimand 2. Effective October 22, 2008 1 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the allegations that, in two bankruptcy matters, he neglected his clients' legal matters; failed to act with reasonable diligence and promptness in representing his clients; failed to keep his clients reasonably informed about the status of their matters; failed to explain his clients' matters to the extent reasonably necessary to permit his clients to make informed decisions regarding their representation; failed to make reasonable efforts to expedite litigation consistent with the interests of his clients; and failed to refund the unearned portion of advance fees, in violation of Michigan Court Rule 9.1 04(A)(1)- (4); and Michigan Rules of Profession Conduct 1.1(c); 1.3; 1.4(a) and (b); 1.16(d); 3.2; and 8.4(a).
Based on the stipulation of the parties, the hearing panel ordered that respondent be reprimanded and pay restitution in the aggregate amount of $1 ,201.00. Costs were assessed in the amount of $762.22.
