NOTICE OF REVOCATION AND RESTITUTION Case No. 08-58-GA Notice Issued: October 22, 2008

1. Revocation 2. Effective October 17, 2008 The respondent filed an answer to the formal complaint and appeared at the hearing. The panel found that respondent knowingly disobeyed an obligation under the rules of a tribunal when he failed to provide an accounting in a probate matter and failed to return over $38,000 to the probate estate. Respondent also failed to hold client property separate from his own property. The panel further found that respondent, in a bankruptcy matter, failed to provide competent representation to his client; neglected the legal matter entrusted to him; failed to seek the lawful objectives of his client; failed to act with reasonable diligence and promptness in representing his client; and. failed to keep his client reasonably informed and failed to explain the matter to the adequately to his client.

Respondent's conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1; 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.15(d); 3.4(c); and 8.4(a)-(c);

. . The hearing panel ordered that respondent's license to practice law in Michigan be revoked and that he pay restitution in the amount of $38,125.57. Costs were assessed in the amount of $2,204.25.
