NOTICE OF REPRIMAND (By Consent)
Case No. 08-89-GA Notice Issued: September 2, 2008 Bernard A. Jocuns, P 65478, North Branch, Michigan, by the Attorney Discipline Board St. Clair County Hearing Panel #2.
1. Reprimand 2. Effective August 30,2008 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. Respondent pled no contest to the. allegations _that, in a property dispute litigation, he failed to provide competent representation; handled a legal matter which he knew or should have known that- he was not competent to handle, without associating with a lawyer who is competent to handle it; represented a client, or not withdrawing from the-representation of a client, where the representation will result in a violation of the Rules of Professional Conduct; and brought a proceeding, or asserted or controverted an issue therein, unless there is a basis for doing so that is not frivolous.
Respondent was charged with violations of Michigan Rules of professional Conduct 1.1; 1.16(a)(1); and 3.1. Based on the stipulation of the parties, the hearing panel ordered that
respondent be reprimanded. Costs were assessed in the amount of $769.23.
