NOTICE OF DISMISSAL AND NOTICE VACATING ORDER OF SUSPENSION NUNC PRO TUNC

Case No. 05-137-GA Notice Issued: October 16,2008 William R. Cohen, P 57965, Birmingham, Michigan by the Attorney Discipline Board accepting stipulation to vacate Tri-County Hearing Panel #79's order of suspension, nunc pro tunc.

On May 15, 2006, based on respondent's default, Tri-County Hearing Panel #79 ordered that respondent's license to practice law in Michigan be suspended for 120 days, effective June 6, 2006. The Grievance Administrator filed a petition for review and respondent filed a motion and brief to re-open the case due to his lack of actual knowledge of the filing of the formal complaint. The Attorney Discipline Board remanded the matter to a Master for a supplemental report

On June 16, 2008, the parties filed a stipulation to dismiss the matter, ab initio. The Master filed his report on August 22, 2008, recommending that the parties' stipulation be granted and that the matter be dismissed with prejudice and without costs. The parties' stipulation was accepted by the Attorney Discipline Board in an order entered September 18, 2008. No costs were assessed.

2. Effective June 6, 2006 T The respondent was found to be i C n default Afor his failure to file an answer to the formal complaint or appear at the hearing. Based on that default, the hearing panel found that respondent failed to answer a request for investigation; failed to respond to a lawful demand for information from a disciplinary authority; and A made a false statement of material fact in connection with a disciplinary matter. Respondent's conduct was in violation ofMCR 9.1 04(A)(2)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules ofProfessional Conduct 8.1(a)(I) and (2); and 8.4(a) and (b). The panel ordered that respondent's license to practice in Michigan be suspended for 120 days. On June 2, 2006, th Ve Grievance Administrator filed a timely conditional petition for review which will be scheduled for hearing before the Attorney Discipline Board.
