NOTICE OF SUSPENSION AND RESTITUTION Case No. 08-01-GA Notice Issued: August 18, 2008 Jerold C. Smith, P 33921,. Detroit, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #10.
1. Suspension - 45 Days 2. Effective August 16, 2008 1 Respondent filed an answer and appeared at the hearing. Based on respondent's admissions, the hearing panel found that respondent, while suspended from the practice of law, appeared as court-appointed assigned juvenile counsel in the Third judicial Circuit Court; accepted payment from the Court for those appearances; and, contrary to his affidavit filed in accordance with MCR 9.119(A) and (B), failed to notify the Third Judicial Circuit Court, in writing, of his suspension from the practice of law.
Respondent's conduct was in violation of MCR 9.104(A)(1)-(4); MCR 9.119(8); MeR 9.119(E)(1 )-(3); and Michigan Rules of Professional Conduct 1.16(a)(1); 3.4(c); 5.5; 8.4(a)-(c).
The panel ordered that respondent's license to practice law in Michigan be suspended for 45 days and ordered that he pay restitution in the amount of $400.00. Costs were assessed in the amount of $1,724.84.
