NOTICE OF SUSPENSION AND RESTITUTION Case No. 08-20-GA Notice Issued: August 29, 2008

1. Suspension - 2 % Years 2. Effective August 29,2008 The respondent failed to appear at the hearing and was found to be in default for his failure to file an answer to the formal complaint. Based on that default, the panel found that respondent, in a child custody matter, failed to appear for hearings and the court imposed a $750.00 sanction for opposing counsel's attorney fees. Respondent did not satisfy the court's order until 16 months after it had been entered and after opposing counsel had filed a-request for investigation. In a civil matter, when his client's case was dismissed after respondent failed to state a claim of action, opposing counsel filed a motion for sanctions. Respondent's client paid $500.00 and obtained a release from the pending motion for sanctions. Respondent paid $500.00 and the motion for sanctions was withdrawn or dismissed. In a third matter, respondent filed a notice of intent to file a claim on behalf of his client for a wrongful arrest but did not file the claim until well after the statute of limitations had expired.

Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4) and (7); MCR 9.113(A) and (8)(2); and Michigan Rules of Professional Conduct 1.1; 1.4; 3.4(c); 8.1 (a)(2); and 8.4(a).

The panel ordered that respondent's license to practice law in Michigan be suspended for two and a half years and that he pay restitution-in the aggregate amount of $700.00. Costs were assessed in the amount of $1,876.61. -
