Automatic Interim Suspension Vacated June 12, 2008
Respondent pled guilty to Operating While Intoxicated, Third Offense" a felony, in the 54~A District Court. In accordance with MCR 9.120(8)(1), respondent's license to practice law in Michigan was automatically suspended on May 20, 2008, the date of his felony conviction.
Michigan Court Rule 120(8)(1) also states that the Attorney Discipline Board must set aside an attorney's automatic suspension if that conviction is subsequently vacated, reversed, o~ otherwise set aside by the trial court. On June 12, 2008, respondent was sentenced to Sobriety Court and, upon successful completion of that program, his conviction will be entered as a Misdemeanor Second Offense Operating While Intoxicated. Because respondent's conviction will be entered as a misdemeanor, his conviction no longer falls under the automatic suspension provision of MCR 9.120(8)(1). Accordingly, his automatic suspension from the practice of law in Michigan is deemed vacated on June 12, 2008, the date of his sentencing.
