NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION Case No. 07-181-GA Notice Issued: October 24, 2008

1. Suspension - One Year 2. Effective June 24, 2008 The hearing panel found that respondent neglected a legal matter; failed to seek the lawful objectives of his client; failed to act with reasonable diligence and promptness; failed to keep his client reasonably informed of the status of a matter; failed to explain a matter to his client to the extent necessary to permit the client to make informed decisions regarding the representation; failed to return an unearned fee; failed to return papers to which the client is entitled; made a false statement of a material fact to a third party in the course of representing a client; and knowingly failed to respond to a lawful demand for information from a disciplinary authority.

Respondent's conduct was in violation of MCR 9.1 04(A)(1 )-(4); MCR 9.113(A); and Michigan Rules of Professional Conduct 1.1 (c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 4.1; 8.1 (a)(2);

and 8.4(a)-(c).

The panel ordered that respondent's license to practice law in Michigan be suspended for one year, effective June 24, 2008, and that he pay restitution in the amount of $750.00. The panel also ordered that respondent be subject to a condition relevant to the established misconduct. Costs were assessed in the amount of $2,574.22.
