NOTICE OF SUSPENSION WITH CONDITIONS (By Consent)

Case No. 08-73-RD Notice Issued: January 15, 2009 Bryan A. Kutchins, P 25288, Oldsmar, Florida, by the Attorney Discipline Board Tri-County Hearing Panel #9.

1. Suspension - 90 Days 2. Effective May 24, 2008 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MeR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The stipulation contains respondent's admission that he was suspended from practice for 90 days by the Supreme Court of Florida, effective May 24, 2008. The parties agreed that respondent shall be suspended from the practice of law in Michigan for 90 days, retroactive to May 24,2008, and be subject to certain conditions consistent with the conditions contained in the order of suspension entered in Florida.

Pursuant to the agreement of the parties, the hearing panel ordered that respondent's license to practice law in Michigan be suspended for 90 days, retroactive to May 24, 2008, and that he file proof of his compliance with the conditions ordered by the Supreme Court of Florida. Costs were assessed in the amount of $756.11.
