1. Dismissal 2. Effective April 1,2008 The two count formal complaint filed by the Grievance Administrator charged that respondent, in two bankruptcy cases, neglected the matters and failed to refund unearned fees, in violation of Michigan Court Rules 9.104(A)(1)-(4); and (7); and Michigan Rules of Professional Conduct 1.1 (c); 1.3; 1.16(d); 8.4(a) and (c).
The parties stipulated to a dismissal of Count Two, and the hearing panel, upon review of the evidence and testimony, found that the misconduct alleged in Count One was not proved by a preponderance of the evidence and dismissed that count as well. No costs were assessed against respondent.
