FINAL NOTICE OF SUSPENSION (On Remand)

Case No. 09-21-MZ (Ref. 06-12-JC; 07-71-MZ) Notice Issued: June 17, 2011 Michael P. Knapp, Jr., P 57871, Grand Rapids, Michigan, by the Attorney Discipline Board, affirming the order of suspension (on remand) issued by Kent County Hearing Panel #2.

1. Suspension - 4 Years 2. Effective April 9, 2008 The Grievance Administrator filed a petition on April 18,2007, seeking entry of an order increasing discipline for respondent's failure to comply with the hearing panel's order of October 26, 2006. The respondent appeared at the show cause hearing held on June 21, 2007 and presented documentation that he had complied with the panel's order of discipline. His documentation was challenged by the Grievance Administrator and the parties were given an opportunity to address the issue of potential false testimony and/or proffering of a false document.

Based upon the further evidence and testimony submitted by the Grievance Administrator, the panel concluded that respondent had not complied with its previous order, specifically, that respondent failed to comply with valid reporting requirements and submitted false evidence, false statements or other deceptive practices during the disciplinary process. On April 9, 2008, the hearing panel ordered that respondent's license to practice law be revoked.

On February 27, 2009, respondent filed a delayed petition for review. The Attorney Discipline, after review, remanded the matter to the hearing panel for consideration of possible mitigating factors. After conducting further proceedings, the hearing panel issued an order reducing discipline from a revocation to a four year suspension. The Grievance Administrator filed a petition for review, and respondent filed a cross-petition.

On May 19, 2011, the Board issued its order affirming the hearing panel's order of suspension (on remand). Total costs were assessed in the amount of $1 ,618.24.
