The formal complaint filed by the Grievance Administrator charged that respondent misappropriated client funds; failed to refund an unearned attorney fee; and that his conduct was a violation of the Michigan Rules of Professional Conduct; involved dishonesty, deceit, or violation of the criminal law where such conduct reflects adversely on the lawyer's honesty, trustworthiness or fitness as a lawyer; was prejudicial to the administration of justice; exposed the legal profession or the courts to obloquy, contempt, censure, or reproach; and was contrary to justice, ethics, honesty, or good morals. The complaint further charged that respondent's conduct was in violation of Michigan Court Rules 9. 104(A)(1 )-(4); and Michigan Rules of Professional Conduct 1.15(b); 1.16(d); and 8.4(a)-(c).
The hearing panel, upon review of the evidence and testimony, found that the misconduct alleged in the complaint was not proved by a preponderance ofthe evidence. However, the hearing panel noted that it was concerned regarding respondent's admittedly sloppy bookkeeping.
Formal Complaint 07-58-GA was dismissed and no costs were assessed against respondent.
