Respondent was unable to appear at the show cause hearing due to his physical condition. His counsel requested an adjournment, which was granted, but the hearing panel also issued an order of interim suspension, effective September 11, 2007, for the duration of this matter.

Respondent appeared at the re-scheduled show cause hearing, but did not file any notice providing reasons why an order of discipline should not be entered, nor did he file a notice identifying any specific evidence in mitigation. The hearing panel found that respondent's misdemeanor conviction of operating a motor vehicle while impaired constituted professional misconduct, in violation of Michigan Court Rule 9. 104(A)(5).

Because respondent failed to show cause why an order of discipline should not be entered, the panel ordered that respondent be reprimanded with conditions relevant to the established misconduct. Costs were assessed in the amount of $2,191.67.
