1. Suspension - 180 Days 2. Effective November 28, 2007 The respondent filed an answer and appeared at the public hearing. Based on respondent's admissions and pleas of no contest in his pleadings and testimony, the hearing panel found that respondent, in two litigation matters, neglected the legal matters; failed to seek the lawful objectives of his clients; failed to act with reasonable diligence and promptness; failed to keep his clients reasonably informed about the status of their matters; and failed to explain the matters to the extent necessary to permit his clients to make informed decisions. In one of those matters, respondent also failed to comply with discovery; failed to advise his client of hearing on a motion for default; failed to advise his client that a default judgment had been entered against him; and failed to refund an unearned fee.
The panel found that respondent's conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); and 8.4(a) and (c). The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and pay restitution in the aggregate amount of $9, 384.66. The panel also imposed a condition relevant to the established misconduct. Costs were assessed in the total amount of $1,672.87.
