NOTICE OF SUSPENSION Case No: 07-1 09-GA Notice Issued: February 8, 2008 David A. Kuzava, P 49963, Hastings, Michigan, by the Attorney Discipline Kalamazoo County Hearing Panel #2.
1. Suspension - 120 Days 2. Effective February 6, 2008 The respondent appeared at the hearing but was found to be in default for his failure to file an answer to the formal complaint. Based on that default, the panel found that respondent, in a bankruptcy matter, filed a frivolous action and failed to supervise his secretary. Respondent was also found to have knowingly failed to respond to a lawful demand for information from a disciplinary authority; and failed to file an answer to a request for investigation served upon him by the Grievance Administrator.
Respondent's conduct was in violation of Michigan Court Rules 9.1 04(A)(1 )-(4) and (7); 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 3.1; 5.3(b); 8.1 (a)(2); and 8.4(a)-(c).
The hearing panel ordered that respondent's license to practice law in Michigan be suspended for 120 days and assessed costs in the amount of $2,705.76.
