1. Dismissal 2. Effective November 15, 2007 The formal complaint filed by the Grievance Administrator charged that respondent committed professional misconduct by giving her client incorrect advice concerning whether or not the client's leaving the United States would or could adversely affect the status of the client's appeal from an order denying his application for asylum in the United States. Respondent's conduct was alleged to be in violation of MeR 9.1 04(A)(1), (2) and (4); and Michigan Rules of Professional Conduct 1.1(a) and (b); 1.4(b); 8.4(a) and (c).

The hearing panel found that it was not established that respondent handled a legal matter which she knew or should have known she was not competent to handle; handled a legal matter without preparation adequate in the circumstances; or that she failed to explain the matter to the extent reasonably necessary to permit her client to make informed deci.sions regarding his representation.

Accordingly, Formal Complaint 06~140-GAwas dismissed with prejudice. No costs were assessed against respondent.
