DISMISSAL Case No. 05-145-GA Michael A. Komorn, P 47970, Southfield, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #29.

1. Dismissal 2. Effective October 27,2007 The formal complaint charged that respondent improperly filed an attorney's lien on real property owned by the sister of respondent's client in a criminal matter, in in vio'lation of MCR 9.104{A){1 )-(3); and Michigan Rules of Professional Conduct 3.1 and 8.4{c). The hearing panel foun'd that, "[a]lthough it was not prudent for Respondent to forgo obtaining written authorization, claiming an interest in real property under the circumstances was not violative of the rules."

The panel issued an order of dismissal and respondent filed a motion for sanctions which was denied. On April 17, 2007, the Grievance Administrator filed a petition for review and respondent filed a cross-petition seeking review of the panel's denial of his motion for sanction.

The Attorney Discipline Board, after review, affirmed the panel's order of dismissal and its denial of respondent's requests for sanctions. No costs were assessed.
