NOTICE OF SUSPENSION AND RESTITUTION Case No. 08-12-MZ (Ref. 07-15-GA) Notice Issued: September 15, 2008 Brian J. Gault, P 66051, La Salle, Michigan, by the Attorney Discipline Board Washtenaw County Hearing Panel #4. 1. Suspension - Two Years 2. Effective August 2, 2007 1 The Grievance Administrator filed a petition for order to show cause on February 5, 2008 seeking additional discipline for respondent's failure to comply with the hearing panel's July 11, 2007 order. Specifically, the Grievance Administrator alleged that respondent failed to pay the. restitution and costs which were ordered, and also failed to comply with the applicable provisions of MCR 9.119. Respondent appeared at the hearing and admitted that he had failed to comply hearing panel's order.

Based upon the evidence presented at the show cause hearing and respondent's admissions, the panel concluded that respondent failed to pay restitution, and failed to comply with the applicable provisions of MCR 9.119. The panel ordered that respondent's discipline be increased from a 180 day suspension to a two year suspension, retroactive to August 2, 2007, the effective date of respondent's original suspension. The panel also ordered that respondent pay restitution in the amount of $300.00. Costs were assessed in the amount of $1,703.92.
