NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITIONS (By Consent) Case No. 08-64-GA Notice Issued: March 9, 2009 Ronald J. Plunkett, P 31185, Canton, Michigan, by the Attorney Discipline Board Washtenaw County Hearing Panel #4. 1. Suspension ~ 2 Years 2. Effective August 9, 200r The respondent and Grievance Administrator filed a stipulation for consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent's admission that, in a OWl matter, he failed to seek the lawful objectives of his client through reasonably available means permitted by law; and limited the objectives of the representation without his client's consent. In a second matter, respondent neglected the matter; failed to seek the lawful objectives of his client; failed to act with reasonable diligence and promptness; failed to keep his client reasonably informed about the status of a matter; failed to refund an unearned fee; failed to hold property of his clients or third persons separate from his own and in an IOLTA; and misappropriated client funds.

Respondent's conduct was in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a) and (b); 1.3; 1.4(a); 1.15(b); 1.15(d) (formerly 1.15(a), (d)); 1.16(d); and 8.4(a)-(c).

In accordance with the stipulation approved by the Attorney Grievance Commission, the panel ordered that respondent's license to practice law in Michigan be suspended for two years, to run concurrently with the suspension ordered in Grievance Administrator v Ronald J. Plunkett, Case No. 07-32-GA, which was effective August 9, 2007. The panel also ordered that respondent pay restitution in the amount of $2,500.00 and be subject to conditions relevant to the admitted misconduct. Costs were assessed in the amount of $874.72.
