NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITION Case No. 07-75-GA Notice Issued: September 20, 2007 Shannon H. Pitcher, P 58269, Flint, Michigan, by the Attorney Discipline Board Genesee County Hearing Panel #4.
1. Suspension - 180 Days 2. Effective September 14, 2007 The respondent failed to appear at the hearing and was found to be in default for her failure to file an answer to the formal complaint. Based on that default, the panel found that respondent neglected a legal matter; failed to act with reasonable diligence and promptness in representing a client; failed to keep her client reasonably informed about the status of a legal matter; failed to return the advanced payment of a fee that had not been earned; and failed to answer a request for investigation.
Respondent's conduct was in violation of MCR 9.104(A)(1), (2), (4) and (7); MCR 9.112(C)(1 )(b); MCR 9.113(B)(2); and Michigan Rules of Professional Conduct 1.1 (c); 1.3; 1.4(a);
1.16(d); and 8.1 (a)(2).
The panel ordered that respondent's license to practice law in Michigan be suspended for 180 days and that she pay $2,500.00 in restitution. The panel also ordered that respondent be subject to a condition relevant to the established misconduct and assessed costs in the amount of $1,728.09.
