NOTICE OF REVOCATION AND RESTITUTION

Case Nos. 06-16 4-GA; 06-18 3-FA Notice Issued: July 6,2007 Kathryn M. Niemer, P 39239, Lansing, Michigan, by the Attorney Discipline Board Tri- County Hearing Panel # I2 .

1. Revocation 2. Effective July 6, 2007 Respondent was found to be in default for her failure to file an answer to the formal complaint. Respondent also failed to appear at the public hearing. Based on the default, the panel found that respondent, as Assistant Corporation Counsel for the City of Detroit, failed to seek the lawful objectives of her client; failed to act with reasonable diligence and promptness in representing her client; failed to keep her supervisors reasonably informed about the status of the matters she was handling; failed to explain the matters to her supervisors to the extent reasonably necessary to permit an informed evaluation about the representation; failed to give reasonable notice of the termination of her representation of the City of Detroit; and failed to surrender a client file. Respondent was also found to have failed to answer a request for investigation; and failed to appear for a sworn statement as directed by a subpoena personally served upon her.

Respondent's conduct was in violation of MCR 9.104(A)(I )-(3) and (7); MCR 9.1 13(A) and (B)(2); and Michigan Rules of Professional Conduct I. I(c ); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 8.1 (a)(2); and 8.4(a)-(c).

The panel ordered that respondent's license to practice law be revoked and that she pay costs in the amount of $1,914.95.
