1. Suspension - 3 Years 2. Effective June 22, 2007 The respondent failed to appear at the hearing and was found to be in default for his failure to file an answer to the formal complaint. Based on that default, the panel found that respondent neglected a legal matter; failed to promptly pay or deliver funds that the client was entitled to receive; failed to deposit client funds in an IOLTA account or appropriate non-IOLTA account; and engaged in conduct involving dishonesty, fraud, deceit, misrepresentation, or violation of the criminal law, where such conduct reflects adversely on the lawyer's honesty, trustworthiness, or fitness as a lawyer.
Respondent's conduct was in violation of MCR 9.104(A)(I)-(4); and Michigan Rules of Professional Conduct I.I ( c); 1.3; 1.4(a) and (b); 1.15(b)(3); 1.15(d); 3.2; and 8.4(b) and (c).
The hearing panel ordered that respondent's license to practice law in Michigan be suspended for three years and that he pay restitution in the amount of $25,000.00 and return his $10,020.00 attorney fee. Costs were assessed in the amount of $2,066.90.
