NOTICE OF SUSPENSION WITH CONDITIONS Case No. 06-1 73-GA Notice Issued: April 11,2007 James P. Majkowski, P 33496, Clinton Township, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #107.
1. Suspension - 180 Days 2. Effective April 6, 2007 Respondent was found to be in default for failing to file an answer to the formal complaint. Based on his default, the panel found that respondent failed to withhold from his employee's wages federal and state taxes; failed to pay these taxes over to the respective governmental agencies; and misrepresented to his employee that he had made proper payments to the governmental agencies.
Respondent's conduct was in violation of MCR 9.104(A)(2)-(5); and Michigan Rules of Professional Conduct 8.4(a) and (b).
The panel ordered that respondent's license to practice in Michigan be suspended for 180 days and that he be subject to conditions relevant to the established misconduct. Costs were assessed in the amount of $2,209.26.
