NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITION (By Consent) Case No. 06-17 .9-GA Notice Issued: April 13,2007

Susan S. Pushman, P 53574, Taylor, Michigan by the Attorney Discipline Board Tri-County Hearing Panel #9. 1. Reprimand 2. Effective April 4, 2007 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline containing respondent's plea of no contest to the allegations that, in a driver's license restoration matter, she failed to provide competent representation to a client; failed to act with reasonable diligence and promptness in representing a client; failed to keep a client reasonably informed about the status of a matter and comply promptly with reasonable requests for information; failed to explain a matter to the extent necessary to permit a client to make informed decisions regarding the representation; and failed to refund any advance payment of a fee that had not been earned upon termination of representation. Respondent also pled no contest to allegations that, in an estate planning matter, she failed to act with reasonable diligence and promptness in representing a client; failed to keep a client reasonably informed about the status of a matter and comply promptly with reasonable requests for information; failed to explain a matter to the extent reasonably necessary to permit a client to make informed decisions regarding the representation; and failed to refund any advance payment of a fee that had not been earned upon termination of representation.

Respondent was charged with violations of Michigan Rules of Professional Conduct I .I (a ) and (c); 1.3; 1.4(a) and (b); and 1.16(d). In accordance with the stipulation approved by the Attorney Grievance Commission, the panel ordered that respondent be reprimanded, pay restitution in the amount of $650.00 and be subject to a condition relevant to the alleged misconduct. Costs were assessed in the amount of $760.00.
