DISMISSAL Case No. 06-1 08-GA Andrea J. Ferrara, P 29346, Eastpointe, Michigan, by the Attorney Discipline Board Tri- County Hearing Panel #104.

1. Dismissal 2. Effective April 14, 2007 The formal complaint filed by the Grievance Administrator charged that respondent, in one immigration matter, neglected a legal matter entrusted to her; failed to seek the lawful objectives of her client through reasonably available legal means; and failed to act with reasonable diligence and promptness by failing to file a timely appeal. The Grievance Administrator also charged that respondent, in a second immigration matter; failed to withdraw from representation when discharged by her client; failed to surrender papers and properly to which her client was entitled; and engaged in conduct prejudicial to the administration of justice. In her answer, respondent denied the substantive allegations in the formal complaint.

The hearing panel found that, with regard to Count One, respondent was negligent, rather than neglectful. The panel also stated that "Respondent's behavior, while inexcusably careless and inatten&e, could not be described as a willful disregard . . . " Panel Report 03/23/07, p 1I ] C ount One was dismissed in its entirety. Count Two was also dismissed when the panel found that the

"documents retained by Respondent were retained legally," and that "[tlhere is no evidence that Respondent refused to sign a substitution, or that she took action to delay substituting out." [Panel Report 03/23/07, p 1.51.

Accordingly, Formal Complaint 06-108-GA was dismissed with prejudice. No costs were assessed against respondent.
