CORRECTED NOTICE OF REVOCATION AND RESTITUTION** (By Consent)

Case No. 06-71-GA Notice Issued: November 22, 2006 Michael L. Fifer, P 53677, Canton, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #26.

1. Revocation 1. Effective November 22, 2006 The respondent and the Grievance Administrator submitted a stipulation for consent order of discipline in accordance with MCR 9.115(F)(5) which was approved by the Attorney Grievance Commission and was accepted by a hearing panel. Respondent entered a plea of no contest to engaging in conduct that exposes the legal profession or the courts to obloquy, contempt, censure or reproach; engaging in conduct that is contrary to justice, ethics, honesty, or good morals; engaging in conduct involving dishonesty, fraud, deceit, misrepresentation, or violation of the criminal law, where such conduct reflects adversely on the lawyer=s honesty, trustworthiness or fitness as a lawyer; failing to promptly notify the firm=s personnel of his receipt of fees from firm clients; failing to hold property of clients or third persons in connection with a representation separate from the lawyer=s own property; failing to promptly pay or deliver funds that the firm was entitled to receive, and upon request to promptly render a full accounting of such property; misappropriating funds; and engaging in conduct prejudicial to the administration of justice.

Respondent was charged with violation of MCR 9.104 (A)(1)-(5); MCR 9.119(A) and (B); and the Michigan Rules of Professional Conduct 1.15(b)(1); 1.15(b)(3); 1.15(d); and 8.4(a)-(c).

The parties agreed that respondent=s license to practice law in Michigan should be revoked and that he pay restitution. Costs were assessed in the amount of $1,021.70.
