Effective October 27, 2006 Respondent was found to have committed professional misconduct, based on his misdemeanor conviction for assault or assault and battery, in violation of MCL 750.81(1) in the 17 th Circuit Court. The hearing panel imposed an order of discipline imposing Ano discipline,@ in accordance with Grievance Administrator v Deutch, 455 Mich 149 (1997).
The Grievance Administrator filed a timely petition for review which was heard by the Attorney Discipline Board. On August 21, 2006, the Board issued its opinion and order vacating Kent County Hearing Panel #2's Order of Discipline Imposing ANo Discipline@ and imposing a 30 day suspension with a condition relative to the established misconduct.
Respondent filed a timely motion for reconsideration which was denied by the Board on September 28, 2006. .
