1. Revocation 2. Effective July 22, 2006 1 Respondent was found to be in default for failing to file an answer to the formal complaint and failing to appear at the hearing. Based on that default, the hearing panel found that respondent failed to notify his client of the receipt of settlement funds; failed to promptly pay or deliver the proceeds to his client or to third-parties; failed to hold third-party funds separate from his own in an IOLTA account; misappropriated client and third-party funds; failed to abide by his client=s decision to terminate his
representation; failed to fully and fairly disclose all the facts and circumstances pertaining to the alleged misconduct in his answer to the request for investigation; and failed to respond to the lawful demands for information from the Grievance Administrator.
Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4); MCR 9.113(A); and Michigan Rules of Professional Conduct 1.15(a), (b) and (d); 1.16(a)(3); 8.1(a)(2); and 8.4(a)-(c).
The hearing panel ordered that respondent=s license be revoked and that he pay restitution in the aggregate amount of $3,012.00. Total costs were assessed in the amount of $1,690.72.
