Effective May 3, 2006 1 Based on respondent=s default for his failure to file an answer to the formal complaint and his failure to appear at the hearing, the panel found that respondent, in a living trust matter, failed to advise his client that he had not prepared the living trust; failed to maintain reasonable communication with his client; failed to refund the unearned fees; and abandoned the representation of his client. Respondent was also found to have failed to answer a request for investigation served upon him by the Grievance Administrator.
Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.5(a); 1.16(d); 8.1(a)(2); and 8.4(a) and (c).
The hearing panel ordered that respondent=s license to practice law in Michigan be revoked and that he pay restitution in the amount of $1,500.00. Costs were assessed in the amount of $1,708.04.
