NOTICE OF SUSPENSION AND RESTITUTION WITH CONDITIONS Case No. 05-56-GA Notice Issued: August 25, 2005 Mark J. Anstey, P 43678, Bridgman, Michigan, by the Attorney Discipline Board Kalamazoo County Hearing Panel #3.

1. Suspension - 180 Days 2. Effective December 18, 2005 1 Based on the parties= agreement, the hearing panel found that respondent failed to prepare wills for two clients; abandoned their representation; failed to refund unearned fees; and failed to answer a request for investigation served by the Grievance Administrator.

Respondent=s conduct was in violation of MCR 9.104(A)(1)-(4) and (7); MCR 9.113(A) and (B)(2); and Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.4(a) and (b); 1.16(d); 8.1(a)(2); and 8.4(a)-(c).

The hearing panel ordered that respondent=s license be suspended for 180 days, to run consecutively with respondent=s current suspension in Grievance Administrator v Mark J. Anstey, Case Nos 04-32-JC; 04-33-GA. Respondent was also ordered to comply with conditions relevant to the admitted misconduct and pay restitution in the amount of $380.00. Costs were assessed costs in the amount of $1,802.05.
