NOTICE OF REPRIMAND AND RESTITUTION WITH CONDITION Case No. 04-153-GA Notice Issued: January 13, 2006 James T. Macauley, P 31373, Lansing, Michigan, by the Attorney Discipline Board Ingham County Hearing Panel #6

1. Reprimand 2. Effective January 5, 2006 The hearing panel found that respondent, based on his admissions at the hearing, failed to act with reasonable diligence and promptness; failed to keep his clients reasonably informed about the status of their matters; failed to comply promptly with reasonable requests for information; failed to promptly render a full accounting of his time upon his client=s request; failed to refund the advanced portion of an unearned fee; and engaged in conduct that exposes the legal profession to obloquy, contempt, censure, or reproach.

Respondent=s conduct was in violation MCR 9.104(A)(2); and Michigan Rules of Professional Conduct 1.3; 1.4(a); 1.15(b); and 1.16.

The hearing panel ordered that respondent be reprimanded, pay restitution in the aggregate amount of $1,000.00, and be subject to a condition relevant to the admitted misconduct. Costs were assessed in the amount of $1,868.37.
