NOTICE OF REPRIMAND WITH CONDITIONS (By Consent)

1. Reprimand 2. Effective February 2, 2006 The respondent and the Grievance Administrator filed a stipulation for a consent order of discipline, in accordance with MCR 9.115(F)(5), containing respondent=s plea of no contest to the allegation that respondent failed to make reasonable efforts to ensure that his office had in effect measures to ensure that a nonlawyer employee refrained from conduct which was not compatible with respondent=s professional obligations, including his obligation to establish the attorney/client relationship and fee arrangement with a client; to provide legal advice to the client regarding the merits of and the timeline for filing his appeal; to ensure that he or another attorney within the office established a direct relationship with the client to gather the facts and information regarding the client=s legal matter; and to protect the client=s interest upon termination of representation.

Respondent was charged with a violation of Michigan Rule of Professional Conduct 5.3(a).

The parties agreed that respondent should be reprimanded with conditions relevant to the alleged misconduct. Costs were assessed in the amount of $5,309.06.
