FINAL NOTICE OF SUSPENSION Case No. 05-89-MZ (Ref. 04-154-GA) Notice Issued: June 30, 2006 Eugene Ostrowe, P 24307, Walled Lake, Michigan, by the Attorney Discipline Board Tri-County Hearing Panel #67.

1. Suspension - 180 Days 2. Effective September 28, 2005 The Grievance Administrator filed a petition on July 8, 2005 seeking entry of an order of additional discipline for respondent's failure to comply with the hearing panel's March 10, 2005 order of suspension. The respondent filed an answer and appeared at the show cause hearing held on November 28, 2005.

Based upon the sworn testimony presented at that hearing, the panel concluded that respondent had violated MCR 9.119 and had not complied with its previous order of discipline. Specifically, that respondent was suspended for 180 days and practiced law while suspended; appeared before a court while suspended; held himself out as an attorney by any means while suspended; failed to file with the Macomb County Prosecutor=s office and the 39th District Court a notice of his disqualification from the practice of law; filed a false unsigned affidavit of compliance with the Attorney Discipline Board and the Attorney Grievance Commission and a false signed cover letter; and failed to pay the costs assessed in Grievance Administrator v Eugene Ostrowe, Case No. 04-154-GA.

The hearing panel ordered that respondent's license to practice law be suspended for an additional 180 days, to run consecutively with the original suspension which was effective April 1, 2005. Costs were assessed in the amount of $1,818.43.

The Grievance Administrator filed a timely petition for review but, on June 26, 2006, filed a motion to dismiss that petition. The Board granted the motion and the petition was dismissed on June 27, 2006.
