Effective October 28, 2003 The hearing panel found, by default, that respondent failed to timely file an application for leave to appeal for his client; filed a delayed application for leave to appeal with no legitimate grounds for delay other than his own neglect, which he did not raise; failed to visit or otherwise communicate with his client regarding his appellate rights prior to filing the delayed application; and failed to advise his client that the delayed application for leave to appeal had been dismissed.
Respondent=s conduct was found to be in violation of MCR 9.104(A)(1)-(4); and Michigan Rules of Professional Conduct 1.1(a) and (c); 1.3; 1.4(a) and (b); 3.1; 3.2; and 8.4(a) and (c). The hearing panel ordered that respondent=s license to practice be suspended for 180 days and assessed costs in the amount of $1,809.06.
